Terms of Service

1. Acceptance of these terms

These Terms of Service ("Terms") are a binding agreement between you and TradeSync Market ("TradeSync Market," "we," "us," or "our") governing your access to and use of tradesyncmarket.com, app.tradesyncmarket.com, and any related content, tools, or membership services (together, the "Service"). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms, our Privacy Policy, and our Risk Disclosure. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service you represent that you meet these requirements and that your use of the Service does not violate any law or regulation applicable to you, including in the jurisdiction where you reside or trade.

3. Nature of the Service

TradeSync Market is a financial media and education product. We publish charted trade ideas, market commentary, watchlists, and related tooling (including an AI research copilot) for informational and educational purposes only. Nothing published on the Service is, or should be construed as, personalized investment advice, a recommendation to buy or sell any security or instrument, or an offer or solicitation of any kind. TradeSync Market is not a registered investment adviser, broker-dealer, or financial planner in any jurisdiction, and no advisory or fiduciary relationship is created by your use of the Service.

4. Accounts and security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use of your account. We may suspend or terminate accounts that we reasonably believe are compromised, fraudulent, or in violation of these Terms.

5. Membership and billing

Access to the cabinet area of the Service requires an active paid membership. Memberships are billed on a recurring basis (e.g., monthly or weekly, depending on tier) until cancelled. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period, and no partial-period refunds are issued except where required by law. We may change membership pricing on a going-forward basis with reasonable notice.

Membership accounts are provisioned only in connection with a paid subscription. We do not offer open, self-serve account creation without payment, and we reserve the right to deny, suspend, or revoke access to any account at our discretion, including accounts we determine were not created in connection with a valid, paid subscription.

6. Acceptable use

You agree not to: share your login credentials or resell access to the Service; scrape, copy, redistribute, or republish signals, alerts, or content from the Service without our written permission; use the Service for any unlawful purpose; attempt to interfere with, disrupt, or gain unauthorized access to the Service or its infrastructure; or use the AI copilot or any part of the Service to generate content that violates applicable law or these Terms.

7. No investment advice; assumption of risk

You acknowledge and agree that: (a) all content on the Service, including trade ideas, entries, invalidation levels, targets, watchlists, and AI-generated commentary, is provided "as is" for informational and educational purposes only and does not account for your individual financial situation, objectives, or risk tolerance; (b) trading and investing in stocks, options, and other instruments involves substantial risk of loss, up to and including the total loss of invested capital; (c) past performance of any signal, strategy, or track record is not indicative of future results; (d) you are solely responsible for your own trading and investment decisions, including whether and how to act on any content published on the Service, and for any resulting profit or loss; and (e) you assume full responsibility and risk for your use of the Service. Please read the full Risk Disclosure, which is incorporated into these Terms.

8. Disclaimer of warranties

The Service and all content are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability. We do not warrant that the Service will be uninterrupted, error-free, or that any alert, signal, or price data will be accurate, timely, or complete.

9. Limitation of liability

To the maximum extent permitted by law, TradeSync Market and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, trading losses, or investment losses, arising out of or related to your use of, or inability to use, the Service, even if advised of the possibility of such damages. This includes, without limitation, any losses or lost earnings resulting from any trade idea, signal, alert, price data, timing, or AI-generated content published on the Service, whether or not caused by our negligence.

To the maximum extent permitted by law, our total aggregate liability to you for any claim arising out of or relating to the Service will not exceed the total amount you paid us in membership fees during the twelve (12) months immediately preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless TradeSync Market and its owners, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your trading or investment decisions, your breach of these Terms, or your violation of any law or the rights of a third party.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms. You may stop using the Service and cancel your membership at any time. Sections of these Terms that by their nature should survive termination (including Sections 7 through 10) will survive.

12. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be resolved through binding individual arbitration, and you waive any right to participate in a class action or class-wide arbitration, except where such waiver is prohibited by applicable law.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
